Court of Appeals Hears SKA Appeal on Big Pass Dredging

The 2nd Circuit Court of Appeals (FL) held oral arguments regarding the Lido Key Hurricane and Storm Damage Reduction Project-on November 18. This Appeal is based solely on FL law and statutory language. The focus is whether a Statutory application at a lower court (County ) was incorrect.  SKA contends that 12th Judicial Circuit Court Judge, Andrea McHugh, erred last year in failing to recognize and rule that SKA had a right of action for Injunctive Relief under Florida Statute 403.412(2)(a) “… a citizen of the state may maintain an action for injunctive relief against ” any person, natural or corporate, or governmental agency or authority to enjoin such persons, agencies, or authorities from violating any laws, rules, or regulations for the protection of the air, water, and other natural resources of the state.”. SKA contends that under the Florida statute, the County  Water and Navigational Control Authority (WNCA) ordinance falls within this language.  We await the  decision.  Read full appeal proceedings in Rachel Brown Hackney’s Sarasota News Leader detailed article on the Hearing.
